If you are facing deportation, you should contact an immigration attorney immediately!
At Feldman Feldman & Associates, P.C. we understand how difficult a deportation hearing can be on you and your family. The possibility of a family member or loved one being deported can be devastating. Our San Diego deportation lawyers are committed to doing whatever we can to help. Removal and deportation proceedings are often initiated because of a criminal conviction or other violation of your visa status. If you or a family member are accused of violating your visa status, having a deportation lawyeron your side is important to protect your rights and to maximize your chance to stay. Not acting now to protect your rights may result in deportation and a multi-year or permanent bar to re-entry to the United States.
What is a Deportation or Removal Proceeding?
A deportation or removal proceeding is in front of an immigration judge to determine if a person has the right to remain in the United States. The foreign national’s attorney and the Immigration and Customs Enforcement (ICE) attorney will both present arguments to the immigration judge. Then the immigration judge will either terminate the proceedings, provide relief from removal, offer voluntary departure, or order the immigrant to be removed.
What triggers a Deportation Proceeding to be Initiated?
Deportation proceedings are typically triggered by immigration violations and/or criminal convictions. The categories of the grounds for deportation are:
- People who entered lawfully, but violated their immigration status:
- Working without authorization
- Remaining in the United States past the expiration date on the I-94 card
- Entering the United States without authorization
- Criminal convictions, even permanent residents can be deported
- Individuals whose Asylum applications were denied
- Individuals who have become a public charge within 5 years after entering.
- Members of terrorist or other prohibited organziations
